In a tragic accident in Pune, two young technocrats lost their lives when they were struck by an overspeeding luxury car driven by a teenager returning from a pub, intoxicated along with his friends. This incident, sadly, is all too common in India, where such occurrences barely raise eyebrows. However, the real story unfolds in the aftermath, revealing a web of corruption and privilege.

The teenager's father, Mr. Agrawal, a wealthy builder, and his grandfather used their influence and resources to manipulate the system. Here's a detailed account of how the system was exploited by the wealthy :

  1. Police Inaction: The police constables at the scene failed to report the matter accurately, likely due to bribery or pressure from higher-ups.
  2. Medical Tampering: Doctors at the government hospital were reportedly bribed with Rs 3 lakhs to alter the blood samples, effectively concealing the teenager’s intoxication.
  3. Judicial Leniency: The judge reportedly asked the teenager to merely write a 300-word essay on traffic rules as punishment, letting him off easily.
  4. Diversion and Intimidation: Mr. Agrawal attempted to shift the blame to the family driver and even tried to kidnap him. Local political leaders exerted pressure to ensure the boy evaded legal consequences.
  5. Political Help. The Big politicians having relations with the Father, a Real estate businessman , were there to pressurise the authorities , so as to ensure that the case is covered up.

Despite the successful cover-up, public outrage erupted, leading to the exposure of these corrupt practices. However, with the altered evidence and the boy’s age (17), it is likely that he will be granted bail and may never face conviction. The bereaved parents, residing in Jabalpur and presumably from a middle-class background, are unlikely to have the means to pursue the case vigorously. The government pleader, potentially colluding with the local police and the influential builder, is expected to manipulate the case further, allowing the boy and his family to escape justice.

The Broader Implications

This incident underscores a much larger issue within India’s law enforcement and judicial systems. It illustrates how money and influence can subvert justice, leaving common citizens vulnerable and powerless. The following points highlight the critical lessons and necessary actions:

  1. Systemic Corruption: The law enforcement system is deeply flawed, allowing those with wealth to bypass accountability.
  2. Citizen Responsibility: It is imperative for citizens to actively participate in holding the system accountable. Complacency and inaction only enables corruption to thrive. Praying God ; Hey Bhagwan Apni Nigah sidhi rkhna aur humein har musibat sey bacchana is not going to help the common man. We need to act, because tragedy can struck anyone and sadly the rich will be able to exploit the system whereas the common man will have to run from Pillar to Post for Justice.
  3. Collective Action: By standing together against injustice, citizens can create a robust system that upholds the rule of law and deters corrupt practices.

Let’s all pray that the Father and Grand Father are punished for this crime of his son, because, they are the main culprits.

We shouted our lungs out in 2013 when petrol prices reached above 70 and ridiculed MMS when 65 Indian rupees became equal to a dollar. Fast forward to today, where petrol has surpassed Rs 100 per liter and the dollar stands at Rs 83, yet we find ourselves curiously silent.

Pulses, milk, Atta, vegetables have become so expensive and unaffordable that many amongst us are unable to purchase milk and vegetables. All this would not have mattered if  our salaries would have also grown proportionately.

But the die-hard supporters who are paying through their nose still are not crying their lungs out as they were doing 10 years back. Rather they have suddenly become great geo-political experts and economists ; justifying why the petrol prices have gone up and so on.

While past criticisms in 2013 were also directed at scandals(2G, 3G etc), it's now evident that this administration also isn't exempt from its own share of controversies, from questionable allocations in initiatives like Swachh Bharat toilets and smart cities, electoral bonds and to the lack of transparency and accountability. Even after massive expenditures during demonetization, the influx of liquid cash in the market seems disproportionate to the intended outcome.

So the point is why these die hard supporters are silent despite feeling the pinch and knowing that even this Govt is corrupt and has not been able to manage.

One lady summed it all ; petrol chaiye 200 rupey ho jaaye vote mein modiji ko hi dungi.

This implies that ; individuals have become so emotionally invested with Mr Modi that sometimes override practical considerations, and they may continue to support a leader even when faced with challenges or shortcomings.

So the silence from these staunch supporters in the face of mounting challenges and evident governance lapses is the emotional attachment that transcends mere practicality. In their hearts of heart they know that things are not hunky dory and this slogan of Viksit Bharat by 2047 i.e barely in 23 years, is not a possibility.

But, Emotionally there is so much at stake for them that publicly and within the family these die-hard supporters cannot back out now. They are clinging to hope that Mr Modi in his next term will find solutions for our deteriorating education system, poor health care system, shall eradicate corruption in Govt offices, and make India a super power, a Vishw Guru and so on.

Their ego is now a basic hurdle. They are aware of the pain, their kids going abroad for greener pastures; jobs and education but they just cannot back out now. They in order to justify their stand may even NURTURE animosty with the fellow citizens particularly ;Muslims and Christians.

They have gone so far ahead with this PM, emotionally, that their loyalty has evolved into a barrier driven by ego. Despite the hardships faced, they remain steadfast, tethered to a belief that their chosen leader will eventually deliver on promises made.

As a result, to hide their embarrassment, they furnish silly arguments; to kya Rahul Gandhi ko Pradhan Mantri bana dein, as if all these years India had been a Presidential form of Govt.

For nearly a decade now, I have been employed in a civil organization, that afforded me a close-up view of our law and order system. Sometimes, the most effective way to convey the intricacies of such a system is through a true and poignant story.

Just two days following Diwali this year, tragedy struck in a big town in UP.  A 27-year-old young man, riding his scooter to the market at approximately 9 PM, fell victim to a reckless driver in a formidable SUV, a Fortuner. The collision was forceful, resulting in the untimely death of the young man. In a distressing turn of events, the SUV callously fled the scene, leaving behind a community grappling with grief.

Despite the scarcity of traffic at that hour, the bystanders were unable to capture the vehicle's license plate. However, providence intervened as the young man's friends stumbled upon the broken number plate at the roadside. Remarkably, the owner of the vehicle resided in the same colony, and with the aid of the recovered number plate, the vehicle was swiftly traced. Attempts had been made to conceal the damages, but under community pressure, the covers were removed, unequivocally identifying the vehicle responsible for the tragedy.

This is where the harsh reality of a common man's plight in India unfolds. The owner of a Fortuner, valued at around 50 lakhs, inevitably wields influence. Consequently, the police neither filed the FIR nor seized the vehicle initially. Following a protracted struggle of about 4-5 days, the common man's plea reached someone influential, prompting a belated filing of the FIR. However, the accused now presented was a hapless driver who wasn't even present in the vehicle during the incident.

It is apparent that the destitute driver had likely been compensated and assured of a swift release. This narrative imparts several sobering lessons:

  1. Money can be wielded to manipulate evidence and influence law enforcement.
  2. Financial resources can secure the services of the best legal representation in the country.
  3. In the absence of legally robust evidence, the accused may go free.
  4. The circulation of money perpetuates a nexus involving corruption within the police force, legal practitioners, judges, politicians, and bureaucrats.
  5. Silence from the populace allows this circle of influence to thrive, ultimately leading to the common man's suffering. Today, a grieving mother bore the weight of her son's loss, while the affluent, inebriated driver evaded justice. Tomorrow, any one of us, our children, or our loved ones may fall victim to this insidious cycle, highlighting the urgency for change.

Ultimately in God’s House what will count is What We stood for in Life ; Hatred or Love. Peace or Violence. Justice or Injustice. Fairness or Unfairness, Deceit or Integrity and Not Whether we were a Muslim or a Hindu , A Sikh or a Christian.

Before arriving at this issue Why is the Common man not understanding that there is a need for investigation,

lets first see what were the issues raised by Hindenburg in brief because am sure many must have not even read it but still supporting the Govt.

  1. Key listed Adani companies have substantial debt and are over-leveraged.
  2. Unconventional accounting practices to inflate its profits and understate its debt.
  3. Gautam Adani’s oldest brother created a large number  of shell companies.
  4. Five chief financial officers over the course of eight years. Appointing inexperienced Auditors.
  5. Engaging in insider trading and tax evasion.
  6. Engaging in large-scale deforestation, damaging fragile ecosystems.
  7. Younger brother, accused by the Directorate of Revenue Intelligence (DRI) and was subsequently arrested twice .
  8. Gautam Adani’s brother-in-law, Samir Vora, accused by the DRI in a diamond trading scam.
  9. The Adani Group has previously been the focus of 4 major government fraud investigations .
  10. Two-and-a-half years ago a court in Ahmedabad issued a gag order not to speak or write anything against the interests of the Adani Group.

For explanation of each point you can scroll down.

If even now one can not feel that Adanis should be investigated that lets be sure India is sure to be doomed BECAUSE CORRUPT DO NOT MAKE A NATION STRONG.

EXPLANATION .

One. Key listed Adani companies have substantial debt and are over-leveraged and its shares were pledged. Bombay Stock Exchange data shows the Adani Family Trust pledged stock as collateral across several of the listed companies.

Even The Securities and Exchange Board of India said over the weekend that it was aware of “unusual price movement in the stocks of a business conglomerate” and vowing to examine and take “appropriate” action “if any information comes to SEBI’s notice”.

So, should this not be examined to plug this loop hole so that others do not resort to this.  For a layman its something like this ; you buy a car for Rs 30 lacs, and then take a loan of Rs 30 lacs by inflating its value to 60 lacs and pledging it as collateral. Had you not over valued it perhaps you would not have got so much of loan and if you are not able to pay back the loan , then even when the Bank auctions your car it won't even get 30 lacs.

Should this not be examined.  Now the issue is should the Banks and the SEBI not investigated all this when Adanis were resorting to this practice.

Two. The report alleges that Adani Group has used unconventional accounting practices to inflate its profits and understate its debt. The report claims that the company has booked large amounts of revenue from subsidiaries and joint ventures, which are not consolidated in its financial statements, and that this provides a misleading picture of the company’s financial health and profitability. The subsidiary companies are not mentioned in the financial statements.

Three. Vinod Adani, Gautam Adani’s oldest brother has created a large number (38, by Hindenburg’s count) shell companies, based in Mauritius, and used them specifically for  stock parking / stock manipulation and laundering money through Adani’s private companies onto the listed companies’ balance sheets in order to maintain the appearance of Good financial health“,

Four. Report says Adani companies changed their chief financial officers (CFOs) frequently and that auditors used by the group are relatively unknown. It says Adani Enterprises has had five chief financial officers over the course of eight years, indicating potential accounting issues". The answer given by the adanis does not augur confidence; it said that the audit committee of each of the listed companies is composed entirely of independent directors, and auditors are appointed on their recommendation.

Then the questions arise ;

WHO ARE THE INDEPENDENT DIRECTORS and How Independent are they ?

Why did they employ inexperienced auditors to audit accounts of such a rich company and what benefits does it accrue when one appoints inexperience Auditors?

Now when one sees all these issues from ONE TO FOUR, one obviously finds a connection.  Should this not be examined or should all this be shoved under the carpet saying ; YEH DESH HIT MEY NAHIN HAI.

Is it really in India’s interest to allow a company to inflate its value, fudge its accts and seek loans based on inflated values?

Five. It accuses Adani Group of engaging in insider trading and tax evasion. The report cites documents obtained from Indian government and regulatory agencies, which it claims support these allegations.

Now keeping in mind that Gautam Adanis samadhi Cyril Shroff is reportedly a part of the committee on corporate governance in SEBI i.e. The Securities and Exchange Board of India and is also the CEO of Adani ports and SEZ.

Should this issue not be investigated because many of us do not know How Insider trading would cause a harm to a common trader. Today we have 738 lac demat acct holders and many are indirectly involved in equity trading through SIPs in equity based MFs.

Should we allow our hard earned money be manipulated by crooks.

Six. The report also criticizes Adani Group for its environmental practices, accusing the company of engaging in large-scale deforestation, damaging fragile ecosystems, and polluting groundwater and air. The report claims that Adani Group has ignored the concerns of local communities and has not followed environmental regulations.

Now this may appear to be trivial but it is not. Because We all know how big and small companies for their commercial benefits have flouted and are flouting the environmental rules and norms and causing harm. And it’s the common man who ultimately suffers because its his houses which get flooded, its he who does not get safe drinking water . for instance Builders in bangalore caused permanent damage to almost 50-60 lakes and the recent flooding was the result of this blatant violation. The same happened in uttrakhand. Should this not be investigated and adanis be compelled to follow environment norms. In Australia they could not start mining because of the same issues.

At the end of the report Hindenburg asked some VERY VERY IMPORTANT questions:

Seven . Gautam Adani’s younger brother, Rajesh Adani, was accused by the Directorate of Revenue Intelligence (DRI) of playing a central role in a diamond trading import/export scheme around 2004-2005. He was subsequently arrested twice over allegations of customs tax evasion, forging import documentation and illegal coal imports.

Given this kind of past record, why was he subsequently promoted to serve as Managing Director at the Adani Group?

Eight . Gautam Adani’s brother-in-law, Samir Vora, was accused by the DRI of being a ringleader of a diamond trading scam and of repeatedly making false statements to regulators.

Given his history, why was he subsequently promoted to Executive Director of the critical Adani Australia division?

Nine. The Adani Group has previously been the focus of 4 major government fraud investigations which have alleged money laundering, theft of taxpayer funds and corruption.

Ten. Now very important is the issue of Paranjoy Guha Thakurta, who was the editor of a very renowned Indian journal EPW – ECONOMIC AND POLITICAL WEEKLY .  whose name found prominent mention in the Hindenburg Research report  as this brought international glare on the standard of Indian probity in corporate governance.. Surpsingly, two-and-a-half years ago a court in Ahmedabad issued a gag order asking him not to speak or write anything that may go against the interests of the Adani Group. Do the courts behave like this. And the lawyers representing companies headed by Gautam Adani filed six defamation cases against him.

So, the recent happenings clealry indicate that You cannot silent people for ever, you may by hook or by crook force people to remain silent using coercive means  but in this INTERCONNECTED WORLD the voices will come from some where else and you will have no control over them.

If you do not act you will hurt country’s reputation and its business interests, as it has happened in last few days when FIIs have avoided Indian markets.

Let this be a lesson, transparency may appear to be a nuisance but at the end of the day it pays.

With our experience we all know Big fish in our country do have a tendency to manipulate the system.

We have had numerous businessmen escaping after committing fraud and they have not returned,

Afterall, there are allegations which may or may not be true but we can arrive at the Conclusion only when these allegations are INVESTIGATED.

Decide for your self SHOULD THERE BE AN INVESTIGATION AGAINST THIS MAN or we should harm our nations interest by tarnishing the image of our Institutions.

Most of us have nothing to do with a Political a party nor with Adani but we have gone so far emotionally with current leadership that we find it difficult to look with in.

Choice is yours Behave like Bhishmpitamah or like Sam i.e show Moral courage.
